(b) Whenever a hearing on the petition is requested under this chapter, the court shall commence the hearing not more than ninety (90) days after a petition is filed under this chapter.(c) If a hearing is not held within the time set forth in subsection (b), upon filing a motion with the court by a party, the court shall dismiss the petition without prejudice.[Pre-1997 Recodification Citation: 31-6-5-4.2(a) part.]As added by P.L.1-1997, SEC.18.
