(b) The failure of the judge to answer or to appear at the hearing, standing alone, may not be taken as evidence of the truth of the facts alleged to constitute grounds for censure, retirement, or removal. In any proceeding for involuntary retirement for disability, the failure of the judge to testify in the judge's own behalf or to submit to a medical examination requested by the commission on judicial qualifications may be considered, unless the failure to appear was due to circumstances beyond the judge's control.(c) The proceedings at the hearing shall be reported verbatim.(d) At least four (4) members of the commission on judicial qualifications must be present when the evidence is produced.[Pre-2004 Recodification Citation: 33-5-40-59.]As added by P.L.98-2004, SEC.12.
