This article does not apply to the following:(1) Fertilizers, propellant actuated devices, or propellant activated industrial tools:(A) manufactured;(B) imported;(C) distributed; or(D) used;for their designed purposes.(2) A pesticide that is:(A) manufactured;(B) stored;(C) transported;(D) distributed;(E) possessed; or(F) used;for its designed purposes or in accordance with Chapter 7 of Title 2, the federal Insecticide, Fungicide, and Rodenticide Act, 61 Stat. 163, as amended, and the federal Environmental Pesticide Control Act of 1972, P.L.92-516, as amended.As added by P.L.123-2002, SEC.50.
