(b) The office of executive becomes vacant whenever the executive:(1) dies, resigns, or is removed from office;(2) ceases to be a resident of the county; or(3) is incapacitated to the extent that the executive is unable to perform the executive's duties for more than six (6) months.(c) The vacancy shall be filled under IC 3-13-8.[Pre-Local Government Recodification Citation: 18-4-3-3.]As added by Acts 1980, P.L.212, SEC.2.
