§ 36-7-4-1001

(a) When an appeal from the decision of an official or board has been filed with the board of zoning appeals, proceedings and work on the premises affected shall be stayed unless the official or board certifies to the board of zoning appeals that, by reason of the facts stated in the certificate, a stay would cause imminent peril to life or property. In that case, proceedings or work may not be stayed except by a restraining order.(b) After notice to the officer or board and to the owner of the premises affected and after due cause is shown, the circuit or superior court of the county in which the premises affected are located may grant the restraining order.[Pre-Local Government Recodification Citations: 18-7-2-74; 18-7-4-1001; 18-7-4-81; 18-7-5-85.]As added by Acts 1981, P.L.309, SEC.23.
