If any defendant in any such suit, upon the trial, gives any evidence which existed prior to the time of such adjustment and settlement, and which was not produced to the state comptroller at the time of the settlement, such defendant shall be subject to the costs and charges of the suit.Formerly: Acts 1852, 1RS, c.7, s.10.
