§ 8-1-5-1-10

However, notwithstanding IC 8-1-2-1(g), for purposes of IC 8-1.5-2-4 through IC 8-1.5-2-6.1, the term:(1) 'utility' includes any plant or equipment that is:(A) used within Indiana for the collection, treatment, purification, and disposal in a sanitary manner of liquid and solid waste, sewage, night soil, and industrial waste; and(B) acquired, owned, or operated by a municipality described in subdivision (2); and(2) 'municipally owned utility' includes a municipality that acquires, owns, or operates facilities for the collection, treatment, purification, and disposal in a sanitary manner of liquid and solid waste, sewage, night soil, and industrial waste.As added by Acts 1982, P.L.74, SEC.1.
