(a) Subject to subsection (b), in a proceeding to enforce section 3 of this chapter, the burden is on the defendant to prove by a preponderance of the evidence that the defendant had been issued a driver's license or permit that was valid at the time of the alleged violation.(b) An individual may not be convicted of violating section 3 of this chapter if the individual, within five (5) days from the time of apprehension, produces to the apprehending officer or headquarters of the apprehending officer satisfactory evidence of a permit or driver's license issued to the individual that was valid at the time of the individual's apprehension.[Pre-1991 Recodification Citation: 9-1-4-40(c).]As added by P.L.2-1991, SEC.12.
