70A.2 Promotion, discharge, demotion, or suspension — absence for medically related disability not considered. When supported by the verification of the attending physician that an absence is necessary in the best interest of the health and well-being of the employee, an absence for medically related disability shall not be considered in actions for promotion, discharge, demotion, or suspension of the employee.
