125.43 Funding at mental health institutes. Chapter 230 governs the determination of the costs and payment for treatment provided to persons with a substance use disorder in a mental health institute under the department, except that the charges are not a lien on real estate owned by persons legally liable for support of the person with a substance use disorder and the daily per diem shall be billed at twenty-five percent. The superintendent of a state mental health institute shall total only those expenditures which can be attributed to the cost of providing inpatient treatment to persons with a substance use disorder for purposes of determining the daily per diem. Section 125.44 governs the determination of who is legally liable for the cost of care, maintenance, and treatment of a person with a substance use disorder and of the amount for which the person is liable.
