222.10 Duty of peace officer. When any person with an intellectual disability departs without proper authority from a facility in another state and is found in this state, any peace officer in any county in which such patient is found may take and detain the patient without warrant or order and shall report such detention to the department. The department shall provide for the return of the patient to the authorities in the state from which the unauthorized departure was made. Pending return, such patient may be detained temporarily at one of the institutions of this state governed by the department. The provisions of this section relating to the department shall also apply to the return of other nonresident persons with an intellectual disability having legal residency outside the state of Iowa.
