505.18A State innovation waivers. 1. The commissioner of insurance may develop by rule a state innovation waiver pursuant to section 1332 of the federal Patient Protection and Affordable Care Act, Pub. L. No. 111-148. 2. The commissioner of insurance may submit an application on behalf of the state to the United States secretary of health and human services and the United States secretary of thetreasury for the state innovation waiver developed pursuant to subsection 1. 3. If a state innovation waiver submitted pursuant to subsection 2 is approved by the United States secretary of health and human services and the United States secretary ofthe treasury, the commissioner of insurance may implement the state innovation waiver in amanner consistent with applicable state and federal law. 4. The commissioner of insurance may adopt emergency rules under section 17A.4, subsection 3, and section 17A.5, subsection 2, paragraph 'b', to implement the provisionsof this section and the rules shall be effective immediately upon filing unless a later dateis specified in the rules.
