511.31 Physician’s certificate — estoppel. In any case where the medical examiner, or physician acting as such, of any life insurance company or association doing business in the state shall issue a certificate of health or declarethe applicant a fit subject for insurance, or so report to the company or association or its agentunder the rules and regulations of the company or association, the company or associationshall be estopped from setting up in defense of the action on the policy or certificate that theassured was not in the condition of health required by the policy at the time of the issuance ordelivery of the policy or certificate, unless the policy or certificate was procured by or throughthe fraud or deceit of the assured.
