548.110 Classification. The secretary shall by rule establish a classification of goods and services for convenience in the administration of this chapter, but not limit or extend the applicant’s or registrant’srights, and a single application for registration of a mark may include any or all goods uponwhich, or services with which, the mark is actually being used indicating the appropriateclass or classes of goods or services. If a single application includes goods or services whichfall within multiple classes, the secretary may require payment of a fee for each class. To theextent practical, the classification of goods and services should conform to the classificationadopted by the United States patent and trademark office.
