551A.10 Penalties. 1. A seller who willfully violates the requirements for disclosure or for the contents of a business opportunity contract pursuant to section 551A.3, who provides misleadingadvertising as provided in section 551A.9, who willfully violates a rule under this chapter, orwho willfully violates an order of which the person has notice, upon conviction, is guilty of aclass 'D' felony. Otherwise, a person who violates a rule adopted or order issued under thischapter is, upon conviction, guilty of an aggravated misdemeanor. Each of the acts specifiedconstitutes a separate offense and a prosecution or conviction for any one of such offensesdoes not bar prosecution or conviction for any other offense. 2. A violation of this chapter is an unlawful practice pursuant to section 714.16.3.
