554.10105 Secretary of state exempted from personal liability. 1. The secretary of state and the secretary’s employees or agents are hereby exempted from all personal liability as a result of errors or omissions in the performance of any dutyrequired by the Uniform Commercial Code, as provided in this chapter, except in cases ofwillful negligence. 2. In the event of such error or omission the state of Iowa shall be liable in respect to such claims in the same manner, and to the same extent as a private individual under likecircumstances. 3. Immunity of the state from suit and liability in such case is waived to the extent provided in chapter 669 and said chapter shall govern the extent of liability and the practiceand procedure necessary to establish any liability of the state.
