602.10120 Excuse for nonpayment. When the attorney claims to be entitled to a lien upon the money or property, the attorney is not liable to the penalties of section 602.10119 until the person demanding the moneyproffers sufficient security for the payment of the amount of the attorney’s claim, when it islegally ascertained. Nor is the attorney in any case liable as aforesaid, provided the attorneygives sufficient security that the attorney will pay over the whole or any portion thereof to theclaimant when the claimant is found entitled thereto.
