602.1611 Judicial retirement programs. 1. Judges of the supreme court and court of appeals, district judges, and district associate judges are members of the judicial retirement system established in article 9, part 1, and arenot members of the public employees’ retirement system established in chapter 97B, exceptas provided in paragraphs 'a' and 'b'. a. District associate judges who exercised the election under section 602.11115, subsection 1, are members of the public employees’ retirement system and are not membersof the judicial retirement system. District associate judges who exercised the election undersection 602.11115, subsection 2, are members of the judicial retirement system and areinactive members of the public employees’ retirement system. b. District associate judges appointed after June 30, 1984, judges of the supreme court and court of appeals, and district judges, who were vested members of the public employees’retirement system at the time they became members of the judicial retirement system, andwhose contributions in the public employees’ retirement system were not refunded to themprior to the repeal of section 97B.69, are members of the judicial retirement he judicial retirement system, andwhose contributions in the public employees’ retirement system were not refunded to themprior to the repeal of section 97B.69, are members of the judicial retirement system andare inactive vested members of the public employees’ retirement system until they becomequalified to receive retirement benefits from the judicial retirement system and becomeretired members of the public employees’ retirement system or voluntarily withdraw theircontributions from the public employees’ retirement system. 2. Magistrates shall be members of the Iowa public employees’ retirement system unless the magistrate elects out of coverage under the Iowa public employees’ retirement system asprovided in section 97B.42A. 3.
