624.3 Evidence in equitable actions. In actions cognizable in equity, wherein issues of fact are joined, the court may order the evidence or any part thereof to be taken in the form of depositions, or either party maytake depositions as authorized by law, and may in the discretion of the court be granted acontinuance for that purpose.
