636.29 Property or funds in litigation — deposit. When it is admitted by the pleadings, or shown by the examination of a party, that the party has in the party’s possession, or under the party’s control, any money or property capableof delivery, which is in any degree the subject of litigation, and which is held by the party astrustee for another party, the court may order the same to be deposited in the office of theclerk, or delivered to such party, with or without security, subject to the further direction ofthe court; or may order such money to be deposited in a bank, with the consent of the partiesin interest, to the credit of the court in which the action is pending, and the same shall be paidout by such bank only upon the check of the clerk, annexed to a certified copy of the orderof the court directing such payment.
