714.16C Consumer education and litigation fund. 1. A consumer education and litigation fund is created as a separate fund in the state treasury to be administered by the attorney general. Moneys credited to the fund shall includeamounts received as a result of a state or federal civil consumer fraud judgment or settlement,civil penalties, costs, or attorney fees, and amounts which are specifically directed to thecredit of the fund by the judgment or settlement, and amounts which are designated by thejudgment or settlement for use by the attorney general for consumer litigation or educationpurposes. Moneys designated for consumer reimbursement shall not be credited to the fund,except to the extent that such moneys are permitted to be used for enforcement of section714.16. 2. For each fiscal year, not more than one million one hundred twenty-five thousand dollars is appropriated from the fund to the department of justice to be used for publiceducation relating to consumer fraud and for enforcement of section 714.16 and federalconsumer laws, and not more than seventy-five thousand dollars is appropriated from thefund to the department of justice to be used for investigation, and for enforcement of section 714.16 and federalconsumer laws, and not more than seventy-five thousand dollars is appropriated from thefund to the department of justice to be used for investigation, prosecution, and consumereducation relating to consumer and criminal fraud committed against older Iowans. 3. Notwithstanding section 8.33, moneys credited to the fund shall not revert to any other fund.
