217.811 Application and fee for permit -- Exemptions. (1) The cabinet shall promulgate administrative regulations to establish a fee that: (a) Shall be the total of the operational and administrative costs of the programs to the cabinet and to agencies as defined in KRS 211.185; (b) Beginning on March 17, 2020, u ntil December 31, 2020, shall not increase more than twenty -five percent (25%) of the fee amount on March 17, 2020; and (c) Beginning on or after January 1, 2021, shall not increase more than five percent (5%) for each year thereafter. (2) The fee shall be paid with each application for permit to operate a vending machine company for each vending machine commissary plus a fee for the total number of vending machines operated by the applicant. (3) Vending machines dispensing only bottled or canned soft drink s; prepackaged nonpotentially hazardous food; chewing gum, nuts, and/or candies shall be exempt from the permit and fee requirements of KRS 217.808 to 217.812.
