286.3 -187 Bank acting as agent of another financial institution -- Filing -- Commissioner's approval -- Scope of activities. (1) Except as set forth in subsection (7) of this section, with prior approval of the commissioner and upon compliance with the requir ements of this section, any state bank may agree to receive deposits, renew time deposits, close loans, service loans, receive payments on loans and other obligations, and perform other services as may be authorized by administrative regulations, as an age nt for any national bank, savings and loan, or savings bank having its principal office in Kentucky or any state bank. (2) A state bank that proposes to enter into an agency agreement under this section shall file with the commissioner, at least thirty (30 ) days before the effective date of the agreement: (a) A notice of intention to enter into an agency agreement with a national bank, savings and loan, or savings bank having its principal office in Kentucky or a state bank; (b) A description of the service s to be performed under the agency agreement; and (c) A copy of the agency agreement.

(5) A state bank acting as an agent for a state bank or a national bank, savings and loan, or savings bank having its principal office in Kentucky in accordance with this section shall not be considered to be a branch of that institution.
