309.422 Providing home medical equipment and services without license -- Penalty. (1) A person who engages in the business of providing home medical equipment and services and who is required to be licensed under KRS 309.412 or 309.420 and who knowingly provides home medical equipment and services without a license issued by the board commits a Class A misdemeanor. (2) Each day a violation of this section continues constitutes a separate offense. Effective: July 15, 2016 History: Repealed, reenacted, renumbered, and amended 2016 Ky. Acts ch. 103, sec. 10 (this statute) reads in part '…who is required to be licensed under Section 5 or 7 of this Act…' Section 5 of that Act was KRS 309.414, which prescribes the process for applying for a license as a home medical equipment and services provider, and Section 7 of that Act was KRS 309.420, which provides license reciprocity in Kentucky for providers licens ed in another state.

Acts ch. 103, sec. 10, the Reviser of Statutes has changed the citation as codified in subsection (1) of this statute to read in part '…who is required to be licensed under KRS 309.412 or 309.420 …' to correct this manifest clerical or typogr aphical error under the authority of KRS 7.136(1)(h).
