315.220 Powers of representatives of board. (1) For the purpose of enforcing the provisions of this chapter, officers, agents, and inspectors of the board shall have the power and authority to: (a) Administer oaths; (b) Enter upon premises of all facilities issued a permit or license by the board, at all reasonable times for the purpose of: 1. Making inspections and carrying out the provisions of this chapter; 2. Conducting investigations; 3. Requiring production of books, papers, documents, records, or other evidence for inspection or copying; 4. Seizin g evidence; or 5. Securing oral or written statements; (c) Employ special investigators; (d) Expend funds for the purpose of obtaining evidence; and (e) Issue subpoenas. (2) As used in subsection (1) of this section, 'records' includes, but is not limited to, patient records. (3) Any decision to inspect, copy, or seize books, papers, documents, records, or other evidence shall be at the discretion of the officer, agent, or inspector of the board.
