382.077 Immediate recording -- Priority of documents. Documents physically presented to a county clerk for recording during regular business hours shall be considered for immediate recording if requested by the party presenting the documents, except that the county clerk may refuse unreasonable requests. Docu ments delivered by all other methods shall be processed as they are received, with priority assigned by the date the documents are received. All documents received on a given date shall have equal priority, and the county clerk shall have discretion to dec ide in what order documents are processed. A county clerk shall be held harmless for any disputes that arise regarding the timing of a recorded document. Effective: January 1, 2020 History: Created 2019 Ky.
