438.307 Enforcement by Department of Alcoholic Beverage Control -- Online publication of list of retailers of authorized vapor products. The department shall: (1) (a) Enforce KRS 438.308, 438.309, 438.312, and 438.316; and (b) Not enforce KRS 4 38.308, 438.309, and 438.316 against manufacturers, distributors, and wholesalers of vapor products that are not intended for resale in this state; (2) On the first day of each month, update and publish online the list of retailers of authorized vapor prod ucts provided by the Secretary of State under KRS 438.306; and (3) Develop, maintain, and utilize a coordinated tobacco noncompliance database and reporting system to: (a) Identify the retailers that have violated KRS 438.312 or 438.316; and (b) Publish th at information online on the first day of each month.
