452.495 When defendant in transitory action is immune from summons. In an action brought pursuant to KRS 452.480, a defendant who is summoned out of the county in which it is brought, and who did not reside therein when the action was begun, can not be summoned in that or any other action of the plaintiff whilst visiting s uch county for the sole purpose of defending the first -named action.
