RS 37:3474.3 - Injunction proceedings; penalties A. The board may seek in any court of competent jurisdiction a writ of injunction enjoining any person from participating in distribution as defined by this Chapter until such person obtains the necessary license under the provisions of this Chapter. Posting of a bond shall not be a cause for dissolution of the injunction. B. In the suit for an injunction, the board may demand of the defendant a penalty of not more than five thousand dollars, reasonable attorney fees, and court costs. This judgment for penalty, attorney fees, and court costs may be rendered in the same judgment in which the injunction is made absolute. C. The trial of the proceeding by injunction shall be summary and by the judge, without a jury. D. This Section shall not be construed as barring criminal prosecution for violations of this Chapter.
