RS 39:1678 - Remedies after an award If it is determined after an award that a solicitation or award of a contract is in violation of law, then: (1) If the person awarded the contract has not acted fraudulently or in bad faith: (a) The contract may be ratified and affirmed, provided it is determined in writing by the commissioner that doing so is in the best interests of the state and the law violation had no significant effect on the outcome of the contract award; or (b) The contract may be terminated and the person awarded the contract shall be compensated for the actual expenses reasonably incurred under the contract prior to the termination, provided that any administrative determination of such costs shall be subject to the written concurrence of the attorney general. (2) If the person awarded the contract has acted fraudulently or in bad faith, the contract shall be declared null and void. Added by Acts 1979, No. 715, §1, eff.
