RS 40:1646.3 - Inoperative or deficient systems; remediation; hearings A. If the inspector determines that the fire sprinkler system is inoperative or deficient, he shall describe these facts in detail on his report. B. The fire marshal, as soon as practicable after receipt of this report, shall notify the building owner by certified mail or hand delivery of the date by which remediation must be made. C. If the owner disputes the findings of the report, he may request, within fifteen days of the date on which the fire marshal's notice was posted or delivered, a hearing to resolve the dispute. The hearing shall be conducted as soon as possible and in accordance with the Administrative Procedure Act. D. A final determination by the fire marshal may be appealed to any court of competent jurisdiction. E. If remedial action is finally determined to be necessary, the owner shall cause an inspection to be made after completion of the remediation in the same manner as other inspections required by this Subpart.
