Section 12-2604 - Authority of Board to Subpoena Records

(a) The Board may subpoena records pertaining to a licensed establishment. (b) (1) The Board may petition the circuit court if a witness refuses to produce a subpoenaed record. (2) The court may proceed by attachment against the witness as if the refusal had been by a witness summoned to appear in a case pending before the court. (c) (1) The Board may charge fees for the production and service of a summons and hearing notice. (2) The fees are: (i) $25, for the production of hearing notices or summonses requested by parties appearing before the Board; (ii) $5, for each address served if the address is provided to the Board and the service is by mail; and (iii) $25, for each address served if the service is performed by an employee of the Board. (3) In addition to any other fine, penalty, or cost, the Board may impose a $100 administrative hearing fee on a license holder: (i) whom the Board charges with a violation of law concerning the sale of alcoholic beverages; or (ii) who requests a transfer or expansion of the license or a new license.
