(a) There is a Class B–theater license. (b) The Board may issue the license for use in a theater that: (1) is operated by a nonprofit organization; (2) appears on the National Register of Historic Places; (3) accommodates at least 1,400 individuals; and (4) is located on the south side of Hagerstown. (c) The license authorizes the license holder to sell beer, wine, and liquor for on–premises consumption only to individuals who attend a performance or an event held at the theater. (d) The license holder may sell beer, wine, and liquor during the hours and days as set out for a Class B beer, wine, and liquor license under § 31–2004 of this title. (e) (1) The annual license fee is $200. (2) The fee for a Sunday permit is $250.
