Section 33-307 - Dispensaries

(a) The Department may establish and maintain stores known as 'dispensaries'. (b) A dispensary: (1) may sell any alcoholic beverage except beer; and (2) shall sell alcoholic beverages in a sealed package or container. (c) The Department may establish and maintain dispensaries only in: (1) Berlin; (2) Ocean City; (3) Pocomoke City; (4) Snow Hill; (5) a rural area approved by the Department and the County Commissioners; and (6) a housing development that: (i) has a population of at least 10,000 individuals; (ii) is overseen by a homeowners association; and (iii) has a special police force commissioned under Title 3, Subtitle 3 of the Public Safety Article. (d) The Department may sell or deliver liquor to a retail license holder from 6 a.m. to midnight Monday through Saturday and from 9 a.m. to 5 p.m. on Sunday. (e) A person may not open or consume the contents of a sealed package or container containing alcoholic beverages on the premises of the dispensary where sold. (f) Title 4, Subtitle 2 of this article does not apply to this section.
