Section 16-602 - Hearings

(a) Except as otherwise provided in § 10–226 of the State Government Article, before the Commission takes any final action under § 16–701, § 16–701.1, or § 16–701.2 of this title, it shall give the individual against whom the action is contemplated an opportunity for a hearing before: (1) the Commission; or (2) the Hearing Board for proceedings under § 16–211 of this title. (b) The Commission shall give notice and hold the hearing in accordance with Title 10, Subtitle 2 of the State Government Article. (c) The Commission may administer oaths in connection with any proceeding under this section. (d) The hearing notice to be given to the individual shall be sent by certified mail to the last known address of the individual at least 10 days before the hearing. (e) The individual may be represented at the hearing by counsel. (f) (1) The Commission may issue subpoenas in connection with any proceeding under this section. (2) If a person fails to comply with a subpoena issued under this subsection, on petition of the Commission, a circuit court may compel compliance with the subpoena. (g) If, after due notice, the individual against whom the action is contemplated fails or refuses to
