Section 7-109 - Use of School Property for Other Than School Purposes -- Priority for Day Care Program

(a) If the program and public school facility comply with the rules and regulations of the Department that govern group child care centers, each county board: (1) Shall give priority to nonprofit child care programs for use of public school facilities before and after school hours; (2) May make space available during school hours; and (3) May lease any part of public school property for the construction or operation of a child care center if: (i) The county board determines that the property will not be needed for public school use during the term of the lease; and (ii) The term of the lease is not greater than 20 years. (b) Each county board shall adopt rules and regulations for implementing this program that are consistent with the rules and regulations of the Department that govern group child care centers. (c) Any additional costs incurred in the administration or support of these child care services shall be paid by the sponsoring organizations in accordance with an annual agreement with the county board that made the facilities available.
