Section 15-123 - Fraud

(a) (1) In this section the following words have the meanings indicated. (2) 'Convicted' includes being convicted after a plea of nolo contendere. (3) 'Fraud' includes the commission of or an attempt or conspiracy to commit the crimes of: (i) Concealment of medical records; (ii) Violation of Title 8, Subtitle 5, Part II of the Criminal Law Article; (iii) False representations relating to Medicaid health plans; (iv) Misappropriation by a fiduciary; and (v) Theft. (b) A health care provider who is convicted of fraud in connection with the Program or a similar federal or State program is ineligible for further payment under the Program.
