Section 14-313 - Issuance of License; Consideration of Criminal History Record Information

(a) Subject to subsection (b) of this section, the Board shall issue a license to any applicant who meets the requirements of this title. (b) (1) On receipt of the criminal history record information of an applicant for licensure forwarded to the Board in accordance with § 14–308.1 of this subtitle, in determining whether to issue a license, the Board shall consider: (i) The age at which the crime was committed; (ii) The nature of the crime; (iii) The circumstances surrounding the crime; (iv) The length of time that has passed since the crime; (v) Subsequent work history; (vi) Employment and character references; and (vii) Other evidence that demonstrates whether the applicant poses a threat to the public health or safety. (2) The Board may not issue a license if the criminal history record information required under § 14–308.1 of this subtitle has not been received.
