Section 4-208 - Contracts of Unauthorized Insurers Not Enforceable

(a) This section does not apply to: (1) lawfully procured surplus lines insurance; or (2) insurance contracts that are independently procured through negotiations occurring entirely outside of the State and that are reported and on which the premium tax is paid under §§ 4-210 and 4-211 of this subtitle. (b) An unauthorized insurer may not enforce an insurance contract effective in the State and entered into by the unauthorized insurer.
