Section 18-402 - Acquisition of Land by Commission in Montgomery County

(a) The Commission may include in its annual budgets provisions for acquiring land needed for public uses in Montgomery County, including: (1) State highways, streets and roads, and mass transit facilities, including busways and light rail facilities; (2) schools; (3) libraries; (4) parks and recreation centers; and (5) government buildings. (b) (1) The Commission shall show each public use to be acquired under this subtitle on the Commission’s general or adopted plan for the physical development of the regional district. (2) An acquisition by the Commission under this section shall receive approval by formal resolution of the district council of Montgomery County. (c) A public use that is not a State highway, street, road, or mass transit facility may not be within a public construction program at the time that the Commission acquires the land. (d) The Commission may not acquire a school site under this section without the prior approval of the Montgomery County Board of Education.
