Section 25-209 - Special Exception -- Sand and Gravel Mining

(a) The Commission shall prepare a report in accordance with this section before a zoning hearing examiner or the district council may conduct a hearing on a request for a special exception to mine sand or gravel. (b) The report shall comprehensively evaluate the request by analyzing the impact of the proposed mining activities on the surrounding area, considering only: (1) noise; (2) watershed and water quality; (3) airshed and air quality; (4) traffic and traffic safety; and (5) other environmental factors relating to the health, safety, and welfare of the residents in the affected area. (c) In addition to the initial filing fee, the applicant shall pay a fee not to exceed $8,000 for the services of the Commission to prepare the report.
