Section 29-104 - Penalties -- Enforcement by Injunction

(a) On application of the Commission that is verified by oath of a member or employee of the Commission, the circuit court of a county, by injunction, may: (1) require the compliance with or restrain the violation of any order, notice, or regulation of the Commission under this division; (2) require compliance with or restrain the violation or attempted violation of a provision of this division; or (3) require the entry of an employee or agent of the Commission within a designated area on the private premises and into any building in the sanitary district where the Commission shows a violation of this division. (b) The court may not require the Commission to post a bond. (c) If the respondent in a petition for injunction under this section is a nonresident of the State, service of process shall be made in accordance with the Maryland Rules. (d) As to §§ 27–101(a) and (b), 27–102, and 27–103 of this article: (1) Montgomery County may apply the provisions of this section if an application is verified by oath of an employee of Montgomery County; and (2) the court may not require Montgomery County to post a bond.
