Section 16-805 - Required Disclosures

(a) (1) Any driver of a commercial motor vehicle holding a driver’s license issued by this State, who is convicted of violating any federal law, State law, or local ordinance relating to operating a motor vehicle in any other state, other than parking violations, shall notify the Administration in the manner specified by the Administration within 30 days of the date of conviction. (2) Any driver of a commercial motor vehicle holding a commercial driver’s license issued by this State, who is convicted of violating any federal law, State law, or local ordinance relating to operating a motor vehicle in this or any other state, other than parking violations, shall notify the driver’s employer in writing of the conviction within 30 days of the date of conviction. (b) Any driver of a commercial motor vehicle whose driver’s license is suspended, revoked, or canceled by any state, or who is disqualified from driving a commercial motor vehicle for any period, shall notify the driver’s employer of the suspension, revocation, cancellation, or disqualification before the end of the business day following the day that the driver received notice of that fact.

(c) Any individual who applies for employment as a driver of a commercial motor vehicle shall provide the employer, at the time of the application, with the following information for the 10 years preceding the date of application: (1) A list of the names and addresses of the applicant’s previous employers for which the applicant was a driver of a commercial motor vehicle; (2) The dates the applicant was employed by each employer; and (3) The reason for leaving that employment. (d) An applicant for employment as a driver of a commercial motor vehicle shall certify that all information furnished on the application is true and complete. (e) Unless otherwise prohibited by law, an employer may require an applicant to provide information in addition to that required by subsection (c) of this section.
