324.8334 Exemptions from penalties. Sec. 8334. The penalties provided for violations of this part do not apply to any of the following: (a) A carrier while lawfully engaged in transporting a pesticide within this state, if the carrier, upon request, permits the director to copy all records showing the transactions in and movement of the pesticide or devices. (b) Public officials of this state and the federal government while engaged in the performance of their official duties in administering the state or federal pesticide laws or regulations. (c) A person who ships a substance or mixture of substances being tested in which the only purpose is to determine its toxicity or other properties and from the use of which the user does not expect to receive any pest control benefit. (d) The shipment or movement of an unregistered or canceled pesticide for the specific purposes of disposal or storage. History: 1994, Act 451, Eff.
