324.31505 Definitions; R to T. Sec. 31505. (1) 'Removal' means the physical elimination of a dam or impoundment. (2) 'Repair' means to substantially restore a dam to its original condition and includes only such restoration as may directly affect the structural integrity of the dam. (3) 'Riparian owner' means a person who has riparian rights. (4) 'Riparian rights' means rights which accrue by operation of law to a landowner on the banks of an inland lake or stream. (5) 'Significant hazard potential dam' means a dam located in an area where its failure may cause damage limited to isolated inhabited homes, agricultural buildings, structures, secondary highways, short line railroads, or public utilities, where environmental degradation may be significant, or where danger to individuals exists. (6) 'Spillway' means a waterway in or about a dam designed for the discharge of water. (7) 'Spillway capacity' means the maximum rate of discharge that will pass through a spillway at design flood elevation. (8) 'Two-hundred year flood' means a flood that has a 0.5% chance of being equaled or exceeded in any given year. History: Add. 1995, Act 59, Imd. Eff.
