556.204 Limited presumption of durability.Sec. 104. A power of attorney created on or after the effective date of this act that is executed in accordance with section 105(2) or (3) is durable unless it expressly provides that it is terminated by the incapacity of the principal. A power of attorney created on or after the effective date of this act that is not executed in accordance with section 105(2) or (3) is not durable. History: 2023, Act 187, Eff. July 1, 2024
