114C.19 VARIANCES THAT PROMOTE POLLUTION REDUCTIONS OR REDUCE UNNECESSARY ADMINISTRATIVE BURDEN. In addition to the grounds for granting a variance set forth in section 116.07, subdivision 5, the Pollution Control Agency may grant variances from its rules in order to: (1) promote reduction in overall levels of pollution beyond what is required by applicable law, consistent with the purposes of this chapter; or (2) reduce the administrative burden on the agency or the permittee, provided that alternative monitoring, testing, notification, record-keeping, or reporting requirements will provide the information needed by the agency to ensure compliance.
