174.58 STATE ROAD CONSTRUCTION PRIOR APPROPRIATIONS. (a) For purposes of this section, 'biennium' has the meaning given in section 16A.011, subdivision 6. (b) An appropriation to the commissioner of transportation for the state road construction budget activity in any prior fiscal year is available to the commissioner in the current fiscal year only to the extent that the commissioner spends the money on the state road construction project for which the money was first encumbered during the biennium in which it was originally appropriated.
