219.752 MINIMUM CREW SIZE. Subdivision 1. Class I or Class II railroad. A Class I railroad or Class II railroad must not operate a train or light engine used in connection with the movement of freight unless it has a crew of a minimum of two individuals. Subd. 2. Class III railroad. (a) For purposes of this subdivision, 'shared corridor' means a segment of railroad track in which light rail transit operates within or adjacent to right-of-way used in freight rail operation. (b) A Class III railroad while operating in a shared corridor must not operate a train or light engine used in connection with the movement of freight unless it has a crew of a minimum of two individuals. Subd. 3. Exemption. The requirements of this section do not apply to hostler services or utility employees. Subd. 4. Penalty; action. (a) Any railroad that willfully violates this section must pay a fine of not less than $250 or more than $1,000 for a first offense, not less than $1,000 or more than $5,000 for a second offense committed within three years of the first offense, and not less than $5,000 nor more than $10,000 for a third or subsequent offense committed within three years of the first offense.
