246.35 ABANDONMENT OF CEMETERY; COURT ORDER. The district court of the county where a cemetery exists on the grounds of a state institution may issue an order authorizing the abandonment and discontinued use of such cemetery when the executive board files affidavits attesting: (1) to all exhumations completed under section 246.34; and (2) that the executive board has thoroughly searched the cemetery on the grounds of the state institution and no people remain buried in the cemetery to the executive board's knowledge, information, and belief.
